These terms govern your use of Imaginary Arts: the imaginaryarts Python library, the rendering API behind it, and this website (together, the Service). By creating an account, using an API key or running a render, you agree to them. If you use the Service on behalf of a company, you confirm you have the authority to bind that company.

Terms of Service

1. What the Service does

You describe a video as a recipe in Python: which clips to generate, which of your own files to include, how to cut them together, what text, voiceover, subtitles and color treatment to apply. When you call .render(), the library sends that recipe to our servers as JSON. We build the assets the recipe asks for, assemble the video, and return the finished file to you.

Where a recipe asks for generated images, video or speech, we make calls on your behalf to third-party AI providers (for example ElevenLabs, Seedance, Veo or Midjourney). Which provider handles which step may change over time as we route each step to the model best suited to it.

2. Your account and API key

• You need an account and an API key to render. Keep your key secret. Anything rendered with your key is treated as rendered by you, and you are responsible for the charges it incurs.
• If you think your key has leaked, revoke it from your account and tell us as soon as you can.
• You must be at least 18 years old, or the age of majority where you live, to use the Service.

3. Pricing and payment

• The Service is pay as you go. There is no subscription and no minimum spend.
• For generative steps we charge the provider's cost plus a 20% markup. Rendering is charged per minute of output video. Current prices are on the pricing section of the home page and in the documentation.
• The library shows an estimated cost before a recipe runs. Estimates are our best guess; the amount charged is based on what the render actually used.
• We cache generated assets so that changing one part of a video does not require regenerating the rest (see Data retention below). You are only charged for assets that are actually generated.
• Prices may change. We will announce changes in advance on the website or by email, and they never apply retroactively.
• Payments are handled by a third-party payment processor. We do not store full card numbers.

4. Your content

Your recipes, your files, your videos are yours. We claim no ownership of the code you write, the assets you upload, or the videos the Service produces for you. You may publish, sell, modify and distribute your output freely.

To run the Service we need a limited licence: you grant us the right to store, copy, process and transmit your content solely for the purpose of rendering your videos, returning them to you, and operating and securing the Service. That licence ends when the content is deleted (see Data retention).

You are responsible for the content you send us. You confirm that you have the rights needed to use every file you upload and every prompt you submit, and that your use of the output does not infringe anyone else's rights.

5. Generated content

Output produced by AI providers is created on your instructions and is delivered to you as is. Generative models can produce results that are inaccurate, unexpected or similar to other people's output, and the legal status of AI-generated material varies by jurisdiction. It is your responsibility to review output before you rely on or publish it.

Each provider has its own terms and content rules. By asking us to use a provider, you agree that your prompts and assets may be sent to it as needed to fulfil your recipe, and that its rules apply to that step.

6. Acceptable use

You may not use the Service to:

• create content that is illegal, or that depicts sexual abuse, promotes violence or hatred against a person or group, or harasses someone;
• create deceptive media of real people without their consent, including deepfakes and impersonation intended to mislead;
• infringe copyright, trademarks or privacy rights, or upload material you do not have the right to use;
• probe, overload, reverse engineer or interfere with the Service, or resell access to our API without our written agreement;
• circumvent usage limits, safety filters or billing.

We may refuse or stop a render, or suspend an account, where we reasonably believe these rules are being broken.

7. Availability and changes

We work hard to keep the Service running, but it is provided without an uptime guarantee. Rendering depends on third-party providers we do not control, and their outages become ours. We may change, add or remove features, and we will give reasonable notice before removing anything you rely on. We keep the library backwards compatible where we can and document breaking changes when we cannot.

8. Disclaimers and liability

The Service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, Imaginary Arts is not liable for indirect, incidental or consequential loss, lost profits, or lost data arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

9. Termination

You can stop using the Service and close your account at any time from your account settings or by emailing us. We may suspend or close accounts that breach these terms, or that have been inactive for a long period, after giving notice where practical. On closure we delete your stored content as described under Data retention.

10. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections in your country of residence.

Privacy Policy

We keep this short because our data practices are simple: we process your content in order to render your videos, and for nothing else.

What we collect

We do not sell personal data, and we do not use advertising trackers on the website.

How we use your content

• Only to render your videos. Your recipes, assets and output are used to produce what you asked for and to return it to you. We do not use them for any other purpose.
• No human review. Nobody at Imaginary Arts looks at your assets or output. The exceptions are when you ask us to for support, or when we are legally required to investigate a report of abuse.
• No model training. We never use your recipes, assets, prompts, code or output to train or fine-tune any AI model, ours or anyone else's. Our contracts with third-party providers require the same of them for data sent through our API.
• Third-party providers. Prompts and assets needed for a generative step are sent to the relevant provider for that step only. We send them the minimum the step requires.

Data retention

Rendering a video often involves many assets, and regenerating them costs money. So we cache the assets you upload and the assets we generate for you in Amazon S3, and reuse them when a later recipe references the same thing. This is why editing one scene of a video only costs the price of that scene.

• Assets, generated output and recipes are kept for as long as your account is active, so they stay available for later renders.
• You can delete individual assets or your whole cache at any time from the library or your account. Deleted files are removed from S3 within 30 days, including from backups.
• When you close your account, all of your content is deleted within 30 days.
• Billing records are kept for as long as tax and accounting law requires, typically 7 years.

Where your data lives

Content is stored on Amazon Web Services. Generative steps are processed by the providers listed above, some of which are outside the UK and the European Economic Area. Where data leaves the UK or EEA we rely on standard contractual clauses or equivalent safeguards.

Security

Data is encrypted in transit and at rest. Access to production systems is restricted to the engineers who need it to run the Service, and is logged. If we become aware of a breach that affects your data, we will tell you without undue delay.

Your rights

Depending on where you live, you may have the right to access, correct, export or delete the personal data we hold about you, to object to or restrict certain processing, and to complain to a supervisory authority (in the UK, the Information Commissioner's Office). To exercise any of these, email contact@imaginaryarts.io. We respond within 30 days.

Cookies

The website uses a small number of cookies and local storage entries that are necessary for logging in and for remembering your preferences, plus privacy-respecting product analytics that help us see which parts of the documentation are used. We do not use them to track you across other sites.

Changes to this policy

If we change these terms or this policy in a way that matters, we will email account holders and update the date at the top of this page at least 14 days before the change takes effect. Continued use of the Service after that date means you accept the new version.
